Our review of new cases and rulings begins with a pair of unfavorable decisions on the exclusion of disability income. We will focus on what is needed to create an exclusion in the event of disability. May was not a good month for litigating taxpayers, who lost all but two of the cases that we will discuss. The “good news,” at least from a certain perspective, is that the IRS audit rate of individual tax returns declined to 0.25 percent, down from 0.9 percent a decade ago.
